TERMS AND CONDITIONS, CAPTURE NEW ZEALAND PHOTOGRAPHY TOURS (CNZPT) RESERVATIONS To make a booking with Capture New Zealand Photography Tours simply fill in the online booking form. Tour spaces will be confirmed in order of receipt and upon payment of deposit. PAYMENT To confirm your tour place payment of the tour deposit is required at time of booking and may be made through our Paypal account, using either your PayPal account or any of the credit/debit card options that PayPal accepts at your location. Once your reservation has been confirmed payment of the tour balance is required at least 90 days prior to the tour commencement date. Payment of the balance of the tour fee may be made by internet banking, International Money Transfer, Paypal or any of the credit/debit card options that PayPal accepts at your location, and Moneybookers. We regret that personal or bank cheques are not accepted. We reserve the right to cancel your booking if payment is not received when due, wherein the Cancellations and Refunds clause, listed below, shall be effected. Fees are quoted in New Zealand dollars. DISCOUNT Save when you pay the balance of the tour fee by Internet Bank Transfer or International Money Transfer: South Island Expedition 12 Day: $150.00 per person on twin-share basis $200.00 for the single traveller Wilderness & Wildlife 14 Day: $200.00 per person on twin-share basis $250.00 for the single traveller Off-road Adventurer 15 Day: $250.00 per person on twin-share basis $300.00 for the single traveller North Island Explorer 7 Day: $75.00 per person on twin-share basis $100.00 for the single traveller South Island Icons 8 Day: $80.00 per person on twin-share basis $110.00 for the single traveller Please note that this discount is applied to the balance of the tour fee invoice payment and not the deposit. CANCELLATIONS AND REFUNDS Should you wish to cancel your booking, you must advise us in writing. Upon receipt of your cancellation the following fees will apply: 90 days or more before commencement: $250 per person 89 to 61 days before commencement: 50% of tour fee 60 or fewer days before commencement: 100% of tour fee No part refunds are made for unused portions or services of a tour, or tour extension, under any circumstances. PRICING Tour fees for 2011 are based on prices as of 1 September 2010. Should price increases occur in such items as transportations, fuel, and accommodations, among others, Capture New Zealand Photography Tours reserves the right to adjust the tour fee accordingly. An increase in tour prices shall not be deemed to be grounds for any refund of fees paid for the tour, other than in accordance with the terms of our cancellation policy. Small group surcharges may apply and will be advised at time of booking. All fees and amounts are quoted in New Zealand dollars (NZD). HEALTH REQUIREMENTS Capture New Zealand Photography Tours are designed to be suitable for people of all ages in good health and moderate fitness. While activities are not strenuous, on some tours we will be taking hikes for several miles on tracks in wilderness areas, including alpine regions, which involve uphill walks and uneven ground. It will be necessary to carry your own camera equipment, extra clothing, food and water for these activities. Should you have any concerns about your own capabilities and/or fitness in relation to a particular tour, please contact us to discuss this before sending your reservation form. You are required to disclose any medical or physical condition that you have which could create a risk for you or any other tour participants. We reserve the right to request a doctor's statement of good health. We reserve the right to decline participation on any tour activity where an individual's health and physical condition is deemed to be unsuitable for the activity undertaken. Once a tour space has been confirmed, medical circumstances will not be considered as exceptions to our cancellation policy. We assume no responsibility for medical care nor guarantee to meet any special dietary requirements. INSURANCE We strongly recommend all participants purchase travel protection insurance as no insurance is included in the tour fee. RESPONSIBILITY The responsibility of Capture New Zealand Photography Tours (CNZPT) is strictly limited. As a tour operator, CNZPT organizes, promotes, and sells tour programs consisting of certain travel services, including, but not limited to, land, air, and water transportation, and accommodations that CNZPT purchases or reserves from various suppliers. CNZPT does not own or operate any of these suppliers. The suppliers are not agents or employees acting for CNZPT. As such, CNZPT is not responsible for any negligent or wilful act or failure to act of any supplier or of any third party. By utilizing the travel services of the suppliers, you agree that you will look to such suppliers for any accident, injury, property damage, or personal loss to you or to those travelling with you, and that CNZPT shall not be liable. CNZPT cannot accept responsibility for losses or extra expenses caused by, but not limited to, delay or changes in any transportation services, weather, illness, injury, strike, quarantine or other causes. All such losses or expenses will be the sole responsibility of the participant. CNZPT reserves the right to cancel any tour prior to commencement, whereupon paid tour funds will be refunded in full, but is not liable for any other tour preparation expenses such as, but not limited to, air ticket penalties, visa fees and medical treatments. CNZPT reserves the right to substitute accommodations of similar category for those indicated and to make any changes in the itinerary or transport where deemed necessary. Where weather conditions or forces of nature restrict or prohibit tour activities, CNZPT reserves the right to alter the tour program and substitute alternative activities. The Acceptance of Risk release must be agreed to by each participant prior to the commencement of the tour. No alterations to the Acceptance of Risk release will be accepted. We regret that we are unable to accept participation in any tour by any persons failing to comply, and no tour fees will be refunded. ACCEPTANCE OF RISK RELEASE By clicking the Submit Booking button, you agree to the following: I agree that while on tour with CNZPT in New Zealand there may be such risks as, but not limited to: sickness, injury, property damage, theft, or delay by forces of nature. I agree that such occurrences are outside the control of CNZPT and are inherent risks possible in any travelling situation. In order to participate in a CNZPT tour I accept all of the risks including, but not limited to, those listed above and release CNZPT from any liability or form of action. I, my family and any other persons agree to waive all rights to legal redress against CNZPT in the event of any occurrence including, but not limited to, the risks mentioned above. All parts of the Terms and Conditions, and the Acceptance of Risk release, shall be governed in all respects by and interpreted in accordance with the law within New Zealand.
