Terms and Conditions

Reservations

To make a booking with Capture New Zealand simply fill in the online registration form. Workshop places will be confirmed in order of receipt and upon payment of deposit.

Payment for New Zealand workshops

To confirm your workshop place payment of the deposit is required upon receipt of invoice and may be made by Internet Bank Transfer or International Bank Transfer. The payment terms for each workshop will be listed under the ‘Workshop Dates and Fee’ section of the itinerary. We reserve the right to cancel your booking if payment is not received when due, wherein the Cancellations and Refunds clause, listed below, shall be effected. Workshop fees are quoted in New Zealand dollars, unless otherwise stated.

Cancellations and refunds

We understand that sometimes unforseen circumstances necessitate the cancelling of participation in one of our workshops. However, once you have registered for a workshop and remitted your deposit we hold your place and make all the necessary arrangements for your participation. This involves logistical commitments where we may be required to make advance payments with strict cancellation or amendment conditions. Also, by holding your place other potential participants may not be able to make a reservation with us. Should you cancel your booking this can represent a financial loss to us.

Should you wish to cancel your booking you must advise us in writing. A structured refund scale is used based on the available time we have before the workshop commences to attempt to fill your place. Upon receipt of your cancellation the following fees will apply:
180 days or more before commencement: 30% of the total fee is forfeited.
179 to 121 days before commencement: 50% of the total fee is forfeited.
120 to 91 days before commencement: 75% of the total fee is forfeited.
90 days or less before commencement: No refund will be issued.

We will do our utmost to re-sell the cancelled workshop place/s and if able to do so will refund all fees paid. All refunds will be subject to the prevailing bank-issued exchange rate, less any associated bank charges and administration fees.

No part refunds will be made for unused portions or services of a workshop.

Should a workshop be cancelled by Capture New Zealand then all paid amounts will be either credited to another workshop or refunded based on the preference of the guest. In the event of a refund the prevailing currency exchange rate will apply.

Trip Cancellation and Interruption Insurance

Trip cancellation insurance is mandatory to protect you from an unexpected event which requires you to cancel your participation in a workshop or conclude your attendance prior to the completion of the workshop.

Itinerary and in-workshop third-party activities

We reserve the right to amend the itinerary at our discretion. If minimum participant numbers are not achieved we reserve the right to amend or cancel scheduled in-workshop third-party activities. Neither of these two conditions are grounds for compensations or part-refunds.

Pricing

At time of workshop announcement all fees have been calculated based on advised supplier rates and known future prices. Should unforeseen price increases occur in such items as transportations, fuel, and accommodations, among others, Capture New Zealand reserves the right to adjust the workshop fee accordingly. An increase in prices shall not be deemed to be grounds for any refund of fees paid for the workshop, other than in accordance with the terms of our cancellation policy. Small group surcharges may apply and will be advised at time of booking. All fees and amounts are quoted in the currency applicable to the workshop location.

Health requirements

Capture New Zealand (CNZ) workshops and tours are designed to be suitable for people of all ages in good health and moderate fitness. While activities are not strenuous, on some workshops we may be taking hikes on tracks in wilderness areas, including alpine regions, which may involve uphill walks and uneven ground. It will be necessary to carry your own camera equipment, extra clothing, food and water for these activities. Should you have any concerns about your own capabilities and/or fitness in relation to a particular workshop, please contact us to discuss this before registering.

It is the responsibility of the participant to advise CNZ of any current or historical health or medical conditions which may impact on the safety and well-being of the participant, the trip leaders or the other participants. It is strongly recommended to disclose any current medications or health issues to CNZ. By joining a CNZ program the participant agrees to assume all responsibility to manage any current or historical health or medical conditions.

CNZ reserves the right to decline participation on any trip activity where an individual's health and physical condition is deemed to be unsuitable for the activity undertaken. CNZ reserves the right to require a participant to withdraw from the program should a health or medical event deem it necessary. In the instance of any of the aforementioned no refund will be made for any unused portions of the program.

Once a workshop place has been confirmed, medical circumstances will not be considered as exceptions to our cancellation policy. We assume no responsibility for medical care nor guarantee to meet any special dietary requirements.

Responsibility

The responsibility of Capture New Zealand (CNZ) is strictly limited. As a workshop operator, CNZ organizes, promotes, and sells programs consisting of certain third party travel services, including, but not limited to, land, air, and water transportation, and accommodations that CNZ purchases or reserves from various suppliers. CNZ does not own or operate any of these suppliers. The suppliers are not agents or employees acting for CNZ. As such, CNZ is not responsible for any negligent or wilful act or failure to act of any supplier or of any third party. By utilizing the travel services of the suppliers, you agree that you will look to such suppliers for any accident, injury, property damage, or personal loss to you or to those travelling with you, and that CNZ shall not be liable. CNZ cannot accept responsibility for losses or extra expenses caused by, but not limited to, delay or changes in any transportation services, weather, illness, injury, strike, quarantine or other causes. All such losses or expenses will be the sole responsibility of the participant. CNZ reserves the right to cancel any trip prior to commencement, whereupon paid funds will be refunded in full subject to the prevailing bank-issued exchange rate, but is not liable for any other trip preparation or associated expenses such as, but not limited to, air ticket penalties, visa fees and medical treatments. CNZ reserves the right to substitute accommodations of similar category for those indicated and to make any changes in the itinerary or transport where deemed necessary. Where weather conditions or forces of nature restrict or prohibit trip activities, CNZ reserves the right to alter the trip program and substitute alternative activities. All parts of the Terms and Conditions shall be governed in all respects by and interpreted in accordance with the law within New Zealand. By checking the Terms and Conditions box on the registration form you implicitly confirm that you have read, fully understand and agree to abide by the Terms and Conditions aforementioned.

Force Majeure

Capture New Zealand (CNZ) will not be liable for any alleged damages because of any circumstances including, but without limitation, explosion, flood, storm, fire, war or threat of war, civil disturbance, sickness, quarantine, weather conditions or other untoward occurrences. If CNZ is affected by force majeure it will notify you of the nature and extent of the incidence. CNZ may amend or cancel an itinerary in the event of force majeure. Refunds or partial refunds will be at the sole discretion of CNZ.

Care for the Environment

All of our New Zealand programs abide by the TIAKI Promise. Tiaki means to care for people and place. By joining our programs you agree to adhere to the principles of the TIAKI Promise, which can be found here.

Use of Testimonials and Images

We reserve the right to use client testimonials for the promotion of our services. During our programs we may take photographs and/or video footage of our clients for the purpose of promoting our services. By attending any of our programs you agree to allow us to use photographs and/or video footage of you in marketing materials: print, website and third-party websites. If you do not wish your image to be used please advise us prior to the commencement of the program.
